Secession?

"New States may be admitted by the Congress into this Union; but no new State shall be formed or erected within the Jurisdiction of any other State; nor shall any other State be formed by the Junction of two or more States, or Part of States, with the Consent of the Legislatures of the States concerned as well as of the Congress."
Question: "Is West Virginia a State?"
If you answer "yes" then according to the U.S. Constitution, secession is legal. Virginia was not part of the United States when West Virginia was created, so West Virginia's creation did not violate Article IV, Section 3 of the Constitution. BUT if Virginia WAS part of the United States (i.e., you hold the view that secession is illegal) when West Virginia was created, then West Virginia is not and never has been a State. It is still part of Virginia. No one in 1861 said that secession was illegal. This view is a byproduct of the Yankee public education** system that was inflicted on the CSA after the war. The southern states left the union, created their own country, were attacked and conquered. They were not attacked because the Lincoln administration thought they were breaking the law, (Lincoln did not think that secession was illegal) they were attacked to be conquered, to expand the Yankee empire. (And looking at the Iraq situation in 2008, Yankees are still Yankees. Iraq was attacked for conquest, to expand the Yankee empire. George Bush being president was irrelevant. Any Yankee president would have done the same thing. Yankees are Yankees.)
After conquest, the conquerors installed legislatures in the southern states, ordering them to apply for re-admission to the union. This farce was carried out and most people think that the union was re-established. This is not what happened. The CSA was conquered and is still an occupied country. These reconstruction legislatures were illegal and nothing more than puppet regimes of the Yankee nation. The current United States was created in 1865 and bears no resemblance to the United States created in 1776.
**There was no such thing as "public education" in the CSA since they adhered to the American view that education is not a function of government. Governments do not educate, they indoctrinate. All schools in the CSA were private.
